1. Acceptance of Terms

By accessing or using Averifly (the "Service"), operated by [Company legal name] ("Averifly", "we", "us" or "our"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users and others who access or use the Service, including anyone submitting a store URL for scanning, whether or not they hold an account.

2. Description of the Service

Averifly crawls publicly accessible pages of a website submitted by a user and evaluates them against a set of deterministic detection rules covering technical health, SEO, catalogue quality, conversion, trust and AI-search readiness (GEO). The result is a scored report identifying issues and, where applicable, recommendations to address them.

The Service only accesses information that is publicly visible to any ordinary visitor or search engine; it does not require, and must not be given, credentials or privileged access to the scanned site.

We may add, modify, or discontinue features of the Service, including detection rules and scoring methodology, at any time.

3. Accounts and Your Responsibilities

To use certain features (recurring scans, saved sites, PDF reports, billing) you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must provide accurate information when creating an account and keep it up to date. You must notify us promptly of any unauthorized use of your account.

You may only submit a URL for scanning if you own the site, are authorized to request a scan of it on behalf of its owner, or otherwise have a legitimate right to request an assessment of its publicly available pages.

4. Subscriptions, Billing and Payment

Averifly offers a free tier (on-demand, single-site scans with limited page coverage and history) and paid subscription plans (Starter, Pro) that unlock recurring scans, higher page limits, longer history and PDF reports. Current plan details and pricing are published on our pricing page and may change from time to time; we will give you reasonable notice of price changes affecting an active subscription.

Paid subscriptions are billed and processed through Stripe, our third-party payment processor. By subscribing, you authorize us, via Stripe, to charge your chosen payment method on a recurring basis (monthly, unless stated otherwise) until you cancel.

You can cancel your subscription at any time from your dashboard billing settings. Cancellation stops future renewals; unless required otherwise by applicable law, we do not provide refunds or credits for partial billing periods, and your plan remains active until the end of the current billing period.

We may suspend or downgrade access to paid features if a payment fails and is not resolved within a reasonable period.

5. Acceptable Use

You agree not to use the Service to: submit a URL you are not authorized to have scanned; attempt to circumvent rate limits, throttling, or access controls; interfere with or disrupt the Service or the servers or networks connected to it; reverse-engineer the Service to replicate its detection rules or scoring methodology for a competing product; or use the Service in a manner that violates applicable law.

We reserve the right to suspend or terminate access for any use we reasonably believe violates these Terms.

6. Disclaimers and Limitation of Liability

Scan results, scores, findings and any estimated revenue-impact figures are provided for informational purposes only. They reflect automated, deterministic checks against publicly visible content at the time of the scan and are not a guarantee of your store's performance, security, legal compliance, or search or AI-engine ranking, and should not be relied upon as the sole basis for a business, technical, or legal decision.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Averifly and its officers, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising from your use of, or inability to use, the Service. Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including disclaimers, limitation of liability, and governing law — will survive.

8. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting a notice on the Service or updating the "last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
